Hire Terms

Definitions:
a) Fast Formwork Hire: refers to any of the businesses, people, individuals, employees, staff, contractors and subcontractors associated with fastformwork.com.au or Fast Formwork Hire NSW PTY LTD
b) User and customer: refers to anyone, any business, any company, any contractor or subcontractor who is given assess to equipment owned or supplied by Fast Formwork Hire.
c) Supplier: any individual, business or associate who has supplied or sold equipment to Fast Formwork Hire.

1. Equipment is provided to customers on the following terms of hire only:
1.1) Fast Formwork Hire, Fast Formwork, staff and suppliers are not responsible for loss or damage resulting from the use of equipment provided.
1.2) Fast Formwork Hire, staff and suppliers are not responsible for income loss or other consequential financial loss resulting from equipment use.
1.3) User of the hired equipment assumes responsibility for the safe and responsible use of the equipment provided by Fast Formwork Hire.
1.4) Fast Formwork is not responsible for the unsafe equipment use by customers.
1.5) Lost or missing equipment will be charged at 20 x weekly rate to help recover the cost of any missing or lost items.
1.6) Broken and damaged equipment will be considered on a case-by-case basis. If equipment is returned broken or damaged due to abuse, cost maybe also recovered by Fast Formwork Hire.
1.7) Customer understands it is their responsibility to return equipment in the same condition it was provided.
1.8) We will consider written agreement to proceed (or payment) as acceptance of our stated terms and conditions.

2. Equipment is provided on the following limited liability terms:
2.1) We will always do our best to only supply equipment that is in good condition. However Fast Formwork Hire is not responsible for loss or damage resulting from equipment failure events with our formwork equipment. If equipment becomes broken due to no fault of the customer, we will replace the defective piece of equipment. Customers assume responsibility for the safe use of equipment hired.
2.2) If we are asked to assist with labour or advice. Fast Formwork Hire, its staff and suppliers are not responsible for income loss or other consequential financial loss resulting from labour services or advice provided.
2.3) Customer agrees to indemnify Fast Formwork Hire, Fast Formwork staff and employees for any associated issues with equipment or service.
2.4) We will consider written agreement to proceed (or payment) as acceptance of our stated terms and conditions.

3. Hire extensions and late returns:
3.1) If hire period is extended we reserve the right to use the credit card provided as hire security to charge for additional hire at the agreed day rate, billed weekly, until equipment is returned.
3.2) If equipment is returned late by the user, we reserve the right to use the credit card provided as hire security to charge for additional hire at the agreed day rate, billed weekly, until equipment is returned.
3.3) If equipment is not returned by the due date, and we were unable to contact the user/customer/hiring person, we will bill weekly up to 8 weeks. If we are still unable to contact the user after 8 weeks (or earlier if the credit card provided is declined) we will consider the equipment lost, missing or stolen and recover costs as required.
3.4) We will consider written agreement to proceed (or payment) as acceptance of our stated terms and conditions.
